Legal framework for the use of our digital communication services

Scope and Subject of the Contract

These terms govern the use of the platform for organizing communication campaigns and managing commercial messages. The service includes the provision of tools for creating, segmenting, and delivering messages to defined recipient groups. Any use beyond this, in particular the unauthorized sharing of access data, is not permitted.

User Obligations

The user undertakes to check all transmitted content for legality before sending. In particular, messages with misleading information, unauthorized advertising, or content that violates applicable law are prohibited. The user ensures that all recipients have consented to the message transmission and that the applicable data protection regulations are complied with.

Limitation of Liability

The service provider is only liable for damages caused by intentional or grossly negligent behavior. No uninterrupted availability of the service is guaranteed. Maintenance work and technical disruptions may lead to temporary restrictions. Liability for indirect damages or lost profits is excluded.

Termination and Duration

The contract for the use of the service may be terminated by either party with a notice period of 14 days to the end of the month. In the event of serious violations of these terms, in particular unlawful use, the service provider is entitled to immediately block access. Services already rendered will not be reimbursed in this case.

Changes to the Terms

The service provider reserves the right to change these terms of use with a notice period of 30 days. The changes will be communicated to the user by email. If the user does not object within 14 days of receiving the notification, the changed terms are deemed accepted. The user will be informed of this legal consequence in the notification.

The place of jurisdiction for all disputes arising from this contractual relationship is the registered office of the service provider, provided the user is a merchant or a legal entity under public law.
